By accessing or using MyBrainOS, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, do not use the service. 1. The Service MyBrainOS provides digital tools for self-reflection, workplace self-regulation insight, coaching support, and educational development. SEEFA — the Workplace Executive Self-Regulation Profile — is a non-clinical developmental assessment. It helps users understand how self-reported executive self-regulation patterns may show up in work or study. SEEFA may include brief or full assessment versions, environmental-fit questions, contextual questions, quality-control checks, scoring outputs, reports, coaching suggestions, and user-controlled exports. The service is intended for personal development, education, coaching, and aggregate organizational wellbeing insight where appropriate. 2. What SEEFA Is Not SEEFA is not a medical device. SEEFA is not a diagnostic assessment. SEEFA is not a clinical test. SEEFA is not an ADHD test, autism test, dyslexia test, anxiety test, depression test, or objective cognitive ability test. SEEFA does not diagnose, treat, cure, prevent, or assess any medical, psychological, psychiatric, neurological, or neurodevelopmental condition. SEEFA results are not a substitute for advice from a qualified physician, psychologist, therapist, psychiatrist, occupational health professional, or other qualified professional. If your results raise concerns about your wellbeing, work, study, or daily life, you should consider speaking with a qualified professional or a trusted support person. 3. No Employment Decision Use SEEFA must not be used for: hiring firing promotion compensation decisions performance appraisal disciplinary action employee ranking fitness-for-role decisions medical or psychological screening identifying individual employees in organizational reports Employers, managers, HR teams, coaches, and organizations may not use SEEFA results to make decisions that negatively affect an individual’s employment, pay, role, promotion, benefits, or workplace standing. Any individual sharing of results must be controlled by the user. 4. User-Controlled Sharing Your individual SEEFA results are private by default. You may choose to share your results with a coach, psychologist, mentor, manager, or another person you trust. You are responsible for deciding whether, when, and with whom to share your report. If you share your report, the recipient may see sensitive information about your self-reported work patterns, environmental context, and support needs. MyBrainOS is not responsible for decisions you or a third party make after you voluntarily share your results. 5. Organizational and Aggregate Use Organizations may use MyBrainOS only for aggregate wellbeing, coaching, and work-design insight. Organizational reports may include aggregate patterns, environmental demand/support trends, and work-design recommendations. Organizational reports must not reveal individual scores, named employee profiles, individual neurodivergence or diagnosis status, or individual risk scores. Small groups and sensitive subgroups may be suppressed to reduce the risk of identifying individuals. Organizations using MyBrainOS are responsible for ensuring that their use complies with applicable employment, privacy, equality, disability, labor, and data protection laws. 6. Assessment Quality and Metadata To maintain the quality and integrity of SEEFA, MyBrainOS may collect and process assessment metadata. This may include response latency, item order, revision counts, completion status, pause counts, quality-control responses, technical context, and similar data. This information may be used to detect incomplete submissions, automated responses, unusually fast completion, inconsistent responding, bot activity, or other patterns that may affect assessment quality. We may flag, exclude, limit, or withhold interpretation of results where responses fail critical quality-control checks or appear inconsistent with reflective human completion. Slow responding alone is not treated as invalid. It may reflect careful responding, accessibility needs, dyslexia, ADHD, non-native language use, fatigue, assistive technology use, or other legitimate factors. 7. AI-Generated Content MyBrainOS may use artificial intelligence systems to help generate reports, summaries, coaching suggestions, explanations, or other personalized content. AI-generated content may be incomplete, inaccurate, outdated, overly general, or unsuitable for your specific situation. You should use AI-generated suggestions as reflection prompts, not as professional, medical, legal, financial, psychological, or employment advice. You are responsible for how you interpret and apply any strategies, experiments, routines, or suggestions generated by the service. We may change the AI providers, models, prompts, or processing methods used by the service over time. 8. Your Responsibilities You agree to use MyBrainOS lawfully, responsibly, and only for its intended purposes. You agree not to: use the service for employment selection or adverse employment decisions use the service to diagnose or screen medical or psychological conditions submit false, misleading, automated, or fraudulent responses attempt to reverse engineer scoring systems, prompts, models, or proprietary logic scrape, copy, reproduce, or redistribute the service commercially without permission interfere with the security or operation of the service access another user’s account or data without permission use the service in a way that violates privacy, employment, equality, disability, consumer protection, or data protection laws 9. Account Security You are responsible for maintaining the confidentiality of your account credentials and access links. If you create an account, you must provide accurate information and keep your login details secure. You must notify us if you believe your account, report, access token, or export link has been accessed without authorization. We may suspend or restrict access if we reasonably believe an account is being misused, compromised, or used in violation of these Terms. 10. Guest and Anonymous Sessions MyBrainOS may allow users to complete an assessment without creating an account. Guest or anonymous sessions may be linked to a temporary session identifier. You may be able to claim a guest session by creating an account, depending on the product flow. Unclaimed guest sessions may expire, become unavailable, or be deleted after a defined retention period. You are responsible for saving or claiming any guest results you want to keep. 11. Paid Reports and Digital Goods MyBrainOS may offer paid reports, premium analysis, coaching-oriented outputs, subscriptions, or other digital goods. Prices, features, access periods, and availability may change over time. Unless otherwise stated, paid digital reports are delivered electronically. Because digital reports may be generated or made available immediately, purchases may be non-refundable once report generation, delivery, or premium access has begun, except where required by applicable law or where we choose to offer a refund at our discretion. Nothing in these Terms limits any statutory consumer rights that cannot legally be waived. 12. Availability and Changes We aim to keep MyBrainOS available and reliable, but we do not guarantee uninterrupted, error-free, or permanent access. The service may be updated, modified, paused, restricted, or discontinued at any time. We may change assessment items, scoring logic, report structure, AI models, features, pricing, or access rules as the product develops. If we make material changes that affect your rights or obligations, we will take reasonable steps to notify users where appropriate. 13. Intellectual Property MyBrainOS, SEEFA, assessment content, item banks, scoring specifications, report structures, interface designs, logos, text, graphics, software, prompts, models, and related materials are owned by MyBrainOS or its licensors. You may use your own individual results for personal reflection, coaching, education, or user-controlled sharing. You may not copy, reproduce, publish, sell, license, reverse engineer, or commercially exploit the SEEFA methodology, item bank, scoring logic, report templates, prompts, or platform content without written permission. You retain rights to personal information and content you provide, but you grant MyBrainOS the limited rights needed to operate, secure, analyze, improve, and provide the service as described in these Terms and the Privacy Policy. 14. Privacy and Data Rights Your use of MyBrainOS is also governed by our Privacy Policy. The Privacy Policy explains what data we collect, why we collect it, how we use it, how AI processing may be involved, how organizational reporting works, and what rights may be available to you. Depending on your location and applicable law, you may have rights to access, correct, export, delete, restrict, or object to certain processing of your personal data. We may ask you to confirm your identity before completing sensitive requests such as account deletion or data export. 15. Third-Party Services MyBrainOS may rely on third-party providers for hosting, authentication, payments, analytics, error tracking, AI processing, email delivery, and other technical functions. Third-party services may have their own terms, policies, availability limits, and processing practices. We are not responsible for third-party services that we do not control, but we aim to select providers appropriate for the nature of the service. 16. Disclaimers MyBrainOS is provided on an “as is” and “as available” basis. We do not guarantee that the service will be accurate, complete, uninterrupted, secure, error-free, or suitable for your specific needs. We do not guarantee any particular personal, professional, academic, health, wellbeing, financial, coaching, workplace, or organizational outcome. You are responsible for your own decisions and actions based on your use of the service. 17. Limitation of Liability To the maximum extent permitted by law, MyBrainOS and its owners, creators, employees, contractors, partners, and service providers will not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages arising from your use of the service. This includes, but is not limited to, decisions related to work, study, coaching, productivity, health routines, employment, relationships, finances, or wellbeing. Nothing in these Terms excludes liability where it cannot legally be excluded, including liability for fraud, intentional misconduct, or other liability that applicable law does not allow us to limit. 18. Suspension and Termination We may suspend, restrict, or terminate access to the service if we reasonably believe that you have violated these Terms, created security risk, misused the service, infringed intellectual property, violated another person’s rights, or used the platform for prohibited purposes. You may stop using the service at any time. You may request deletion of your account and associated data as described in the Privacy Policy. 19.
